Urgent Dispatch & Cancellation Rights

A120 Mobile Tyres LTD provides emergency and same-day mobile tyre services. Due to the urgent nature of our services, certain cancellation and cooling-off rights are limited or waived as outlined below.

By booking a service with us, you acknowledge and accept these terms.

Emergency Bookings

Emergency bookings are defined as requests where a customer requires immediate roadside assistance due to a tyre failure, puncture, or safety-critical issue.

  • Emergency bookings are dispatched immediately upon confirmation
  • Once a technician has been assigned, the booking cannot be cancelled without incurring the full call-out fee
  • Emergency service requests waive the standard 14-day cooling-off right under the Consumer Contracts Regulations where performance begins with your consent

Same-Day Bookings

Same-day non-emergency bookings are scheduled for prompt service. If you need to cancel a same-day booking, please contact us immediately.

  • Cancellations made before a technician is dispatched may be eligible for a full refund
  • Once the technician is en route, the call-out fee becomes payable
  • Same-day bookings are subject to the same cooling-off waiver for urgent services

Next-Day Bookings

For next-day bookings, customers may cancel up to 2 hours before the scheduled appointment time without charge. Cancellations within 2 hours of the appointment may incur a call-out fee.

Immediate Service Requests

When you request an immediate service and agree to us beginning performance before the end of the cooling-off period, you expressly waive your right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

This applies to all emergency and urgent services where:

  • You have requested an immediate or same-day service
  • You have given explicit consent for performance to begin
  • You acknowledge that your cooling-off rights will be lost once performance begins

14-Day Cooling-Off Information

Under the Consumer Contracts Regulations 2013, you normally have the right to cancel a contract within 14 days without giving any reason.

However, for our services, this right is limited:

  • Emergency and same-day services: The cooling-off right is waived when you request immediate performance and consent to us beginning work. This is standard for emergency tyre fitting and roadside assistance.
  • Pre-booked (non-urgent) services: You may cancel within 14 days, provided no work has begun. If you request earlier performance, you waive your right to cancel for the part already performed.
  • The cooling-off period begins from the date the contract is formed (e.g., when you submit a booking request and we confirm).

Consumer Rights Information

Our services are provided in accordance with the Consumer Rights Act 2015. You are entitled to:

  • Services performed with reasonable care and skill
  • Services provided at a reasonable price (where no fixed price was agreed)
  • Services performed within a reasonable time (where no time was fixed)
  • If services are not performed with reasonable care and skill, we will re-perform the service or provide a price reduction

Waiver of Cooling-Off Rights for Emergency Services

By booking an emergency or immediate service with A120 Mobile Tyres LTD, you expressly agree that:

  • You require us to begin performance immediately
  • You acknowledge that once the service begins, you lose your right to cancel under the 14-day cooling-off period
  • If you cancel after the technician has been dispatched, the call-out fee remains payable
  • This waiver is necessary for us to provide the rapid response service you require

Non-Refundable Call-Out Fee Policy

A call-out fee applies to all mobile tyre fitting and emergency services. This fee covers the cost of dispatching a technician and mobilising resources to your location.

  • The call-out fee is non-refundable once a technician has been dispatched
  • If we are unable to complete the service due to reasons beyond our control (e.g., unsafe location, vehicle not present, incorrect locking wheel nut key), the call-out fee remains payable
  • If we cancel the appointment due to circumstances within our control, you will not be charged

Technician Dispatch Policy

Once you confirm a booking, our dispatch team assigns the nearest available technician. Dispatch decisions are based on:

  • Your location and coverage area (within 30 miles of Braintree, CM77 7TZ)
  • Urgency of the request (emergency vs. pre-booked)
  • Technician availability and workload
  • Tyre stock availability

We aim to provide estimated arrival times but cannot guarantee specific arrival times for emergency services due to variable road and traffic conditions.

To cancel a booking, please contact us as soon as possible:

Summary of cancellation charges:

  • Pre-dispatch cancellation: No charge (non-urgent bookings)
  • Post-dispatch cancellation: Call-out fee applies
  • Emergency service cancellation after dispatch: Full call-out fee
  • Non-attendance (technician arrives, customer not present): Full call-out fee
  • Refusal of service on arrival: Call-out fee may apply
